Bird with prey?

  Does it look like this bird is flying away with a snake in it's talons? There is also another bird on the ground I can't quit identify.

  Flying bird appears to be banking as it turns towards camera, so from top to bottom you see wing, wing, tail - that's my take! The little yellowish bird might be a yellow-throated longclaw, or a yellow wagtail - can't say.
